  1. SCOPE


Rhinegold Gallery - Martina Reichelt, M.A., Königsallee 92A, 40212 Düsseldorf, Germany, (hereinafter "We" or "Rhinegold Gallery”), provides the website www.rhinegoldgallery.de and offers art, antiques and especially antique and vintage jewellery for sale. The following Terms and Conditions shall apply to all orders and contracts made by Rhinegold Gallery and the customer (“customer”), who either is a private person of full age (“consumer”) according to para. 13 German Civil Code (BGB) or a trader according to para.14 BGB. The customer acknowledges the validity of these Terms and Conditions as part of the order process by clicking on the button “I have read and accept the Terms and Conditions” and by submitting the completed order form. Any terms and conditions of the customer shall not apply unless Rhinegold Gallery has expressly agreed to their validity in advance.



2.1 Presentation

All goods on our website www.rhinegoldgallery.de are presented in a true-to-life manner to the greatest extent possible. Due to different settings or performances of computer monitors or printers, photographs can and may differ from the real appearance. Consistency cannot be guaranteed by Rhinegold Gallery.

2.2 Stock / Product Prices / VAT

Products as presented on our website may be out of stock or unavailable for other reasons.  In this case we will inform you immediately of the unavailability of the item and any amounts credited in advance will be refunded immediately. Unless specified otherwise, all mentioned prices are quoted in Euro including value added tax (VAT), packaging and shipping costs. In accordance with the margin scheme provided under para. 25a, German Value Added Tax Act (UStG), value added tax (VAT) is included in the price of the item, but we must not declare it.

2.3 Seals

All products are delivered with a seal attached. When trying on the items, please be careful not to remove or damage the seal. In the event of cancellation you will have to compensate us should the seal be removed or damaged.



3.1 Contract

The presentation of our goods does not represent a binding offer on our part within the meaning of para. 145 BGB, only the customer`s order of goods represents a binding offer.
All contracts between the customer and Rhinegold Gallery are concluded when the chosen items have been transferred into the shopping bag on the website, the order form has been completed and submitted by clicking the button "Purchase" (binding offer of the customer), and finally the approval of the offer through Rhinegold Gallery by sending an order confirmation email to the email account provided in the order form by the customer or alternatively upon shipping of the goods. The customer accepts the Terms and Conditions of Rhinegold Gallery by clicking on the button “I have read and accept the Terms and Conditions” in the order form. Any mistakes while placing the order can be corrected before submitting the order by using the delete key or the “Back” function in the internet browser. The prices indicated at the time of order shall apply.

3.2 Confirmation of Incoming Order

The automatically generated confirmation of an incoming order sent to the customer at the time of order at www.rhinegoldgallery.de does not constitute an approval of the order. This shall apply in particular for so-called order confirmations by payment service providers which are generated automatically by our emailing system.

3.3 Contents of Contract

With our order confirmation you will receive a rendition of the essential contents of the contract.

3.4 Contract with Rhinegold Gallery

Contracts are concluded exclusively with Rhinegold Gallery, the language of contract is English.

5.1 Redemption

1. Gift certificates remain valid for the recipient for three years. The recipient's name and the expiry date will be noted on the certificate. Gift certificates can be redeemed earliest 14 days after dispatch.

2. Gift certificates must be redeemed at our website www.rhinegoldgallery.de by signing up in “My Account” and by using the shopping bag and checkout procedure when paying for an order.
3. Any gift certificate balance or any unused balance will be credited to the recipient until the gift certificate expires. The original expiry date, if any, applies to any unused funds. Gift certificates and any unused funds cannot be redeemed after their date of expiry.
4. If your order exceeds the amount of your gift certificate, the balance must be paid by credit /debit card, Paypal, SEPA bank transfer or with other gift certificates issued in your name.

5.2 Limitations

Gift certificates cannot be used for the purchase of other gift certificates.
Gift certificates or gift certificate balances cannot be redeemed for cash, transferred to other customer accounts or set against receivables. Gift certificates cannot be resold.

5.3 Limitation of Liability and Risk of Loss

Rhinegold Gallery does not assume liability for typing errors in the address or email address of the recipient. We are not responsible for lost or stolen gift certificates, for any delay of dispatching the gift certificates (e.g. due to technical difficulties) or for gift certificates that are used without permission.

5.4 Fraud

Rhinegold Gallery reserves the right to close customer accounts and/or request alternative forms of payment if a fraudulently obtained gift certificate is redeemed or used at www.rhinegoldgallery.de or if there is suspicion of deception, fraud or other illegal activities in connection with the purchase or the redemption of the gift certificate. Rhinegold Gallery will not cash in or reactivate involved gift certificates.


6.1 Delivery

Our goods will be delivered solely on advance payment. Unless otherwise agreed upon, shipping will be carried out to the address provided by the customer. We do not deliver to freight forwarding addresses, packing stations or P.O. Boxes. Please note that some countries may have restrictions on the import and receipt of certain items. Due to the high value and nature of the goods we ship, a signature is required for all purchases upon delivery.

6.2 Prices / Shipping Costs

The prices indicated at www.rhinegoldgallery.de at the time of order shall apply. The prices are gross prices, i.e. including VAT, packaging and shipping costs. In accordance with the margin scheme provided under para. 25a, German Value Added Tax Act (UStG), VAT is included in the price of the item, but we must not declare it.

6.3 International Shipping

We currently offer free shipping including packaging and insurance to all countries listed in paragraph 6.6.  We do not ship to APO/FPO addresses or P.O. boxes. For delivery to countries not listed in paragraph 6.6 please contact us at info@rhinegoldgallery.de.

6.4 Shipping Partners

Shipping will be carried out by our preferred shipping partners. Their terms and conditions will additionally apply and can be viewed on their respective websites.

6.4.1 Duties and Taxes

The costs for door-to-door delivery, packaging, insurance of the goods and accompanying documents are complimentary and will be paid for by Rhinegold Gallery. Please note that in some countries additional duties may be payable to your local tax authorities on receipt of your delivery. Any such import duties and taxes are the responsibility of the customer. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order. Our shipping partner takes responsibility for such charges and bills the recipient accordingly. We do not receive any part of / profit from customs or import fees. If you refuse to pay these charges or if the consignment is undeliverable, the parcel will be automatically returned to us at our expense. Please note that we will deduct any related charges incurred from the refunded amount of your original purchase. Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

6.5 National Shipping

Within Germany delivery including packaging and insurance is free. We do not ship to P.O. boxes or packing stations (Packstationen). The terms and conditions of Galle Werttransporte which can be viewed at their website www.gallewerttransporte.de shall additionally apply.

6.6 Dispatch and Estimated Delivery Times

Our goal is to dispatch orders within 24 hours, but it may take up to five working days (that is any day on which the banks are open for business in Germany which is not a Saturday or a Sunday) to dispatch your order. Estimated delivery times are to be used only as a guideline and commence from the date of dispatch. Rhinegold Gallery is not responsible for any delays caused by destination customs clearance processes, severe weather or other unforeseen circumstances.

Due to restrictions on jewellery orders we do not ship to Russia.

Should the customer require a specific mode of dispatch (e.g. express delivery), additional costs will apply for him according to the current price list of the assigned shipping company.
With forwarding the goods to the carrier the shipment is carried out at the risk of the customer.


Payments (and eventually applying shipping fees for a specific mode of dispatch, e.g. express delivery) are accepted via credit/debit card, Paypal or SEPA bank transfer. With each order we reserve the right to refuse a certain payment method and indicate another one. In the event that purchased goods are not available, any amounts credited in advance will be refunded immediately by the same method of payment as chosen by the customer for his purchase.
You confirm that the credit/debit card or payment method that is being used is yours and that all details you provide to us in respect thereof including, without limitation, name and address details are complete, correct and veridical. You further confirm that the credit/debit card is valid and the inputted payment details are correct. All credit/debit cardholders and payment account holders are subject to validation checks and authorization by the card issuer or payment method provider. If the issuer of your card or payment method refuses to authorize payment we will not accept your order and we will not be liable for any delay or non-delivery and we are not obliged to inform you of the reason for the refusal.

We are not responsible for any charges or other amounts which may be applied by your card issuer or bank or payment method provider as a result of our processing of your credit/debit card payment or other method of payment in accordance with your order.

If your credit/debit card or payment method is not denominated in the currency of your purchase indicated on our website, the final price may be charged in the currency of your card or account. Such final price is calculated and charged by your card issuer or bank or payment method provider and therefore we shall not be responsible for any cost, expense, charge or other liability which may be incurred or suffered by you as a result of your card issuer or payment method provider charging you in a different currency other than the currency of your purchase as displayed on our website.

7.1 SEPA Bank Transfer

The payment option SEPA (Single Euro Payments Area) bank transfer  is available for the following countries:
all member states of the European Union, Norway, Liechtenstein, Island, Switzerland, Monaco.

By using SEPA bank transfer as payment method, the payment has to be transferred immediately after ordering the goods. Acceptance of contract and dispatch of order will ensue the receipt of payment. Should the transfer of the purchase price and eventually applying shipping fees for a specific mode of dispatch not be received within 4 working days since ordering date, Rhinegold Gallery reserves the right to cancel the order.

7.2 Credit Card

We accept Visa, MasterCard and American Express.
For security reasons, first-time orders can only be shipped to the cardholder´s billing address or a corporate work address which we are able to independently verify. To avoid delays, please make sure that your billing address matches the address on your credit card statement, and that the cardholder´s name is written exactly as it appears on your credit card. In the unlikely event that we need to contact you during the authentication process, please ensure that your contact details are accurate.

7.2.1 American Express

When shipping to a delivery address other than your billing address, American Express must have your alternative delivery address in their system. To limit delays when processing your order, please contact American Express and give them your alternative delivery address prior to placing your order. We will contact American Express to verify your alternative delivery address during the order confirmation process.

7.3 Security

Rhinegold Gallery works with the security software SSL (Secure Socket Layer), which is based on asymmetrical encryption to prevent malpractice or deception or copying of credit card information during the purchase process and which automatically ensures that neither Rhinegold Gallery nor any third parties have access to this information. This credit card information will only be used again for after purchase transactions in the case of refunds. Please note that this is a direct withdrawal immediately after purchase.



All goods will remain in our property until payment is received in full.



9.1 Condition of Goods

All instructions, designs, illustrations, technical data, weight, measurement and performance specifications which are contained in our website, product folders, catalogues, circulars, announcements or price lists, have a purely informative character. Although we try our best to ensure accuracy, we do not guarantee the correctness of such information.

9.2 Liability

Liability in the case of material defects or defects of title shall follow the statutory provisions in force in the Federal Republic of Germany.
Compensation for consequential damage caused by defects in delivered goods shall be excluded.
Rhinegold Gallery shall not be liable for other than by injury of lives, bodies and health developing damages, unless caused by Rhinegold Gallery or its employees, representatives or supporters with gross negligence or intent or based on culpable injury of a primary contractual obligation by Rhinegold Gallery or its employees, representatives or supporters. Any further liability shall be ruled out, except of such under the German Product Liability Act or liability for an expressly warranted condition or defects which have been suppressed maliciously.
Data communication over the internet cannot be ensured error free and/or at any time available after the present state of the art. Therefore we are not liable for the constant and continuous availability of our website or any occurring technical or electronic errors beyond our control during the order process. We are not responsible or liable for the availability and the content of third party’s websites reachable over hyperlinks from our website. The content of third party’s websites will not be appropriated by Rhinegold Gallery in any case and any liability or warranty shall be ruled out provided that in individual cases Rhinegold Gallery has no awareness of the unlawfulness of the contents.

9.3 Statute of Limitation

The statute of limitation for legal claims of defects shall be accounted for 1 year and shall begin with the delivery date, i.e. receipt of the product by the customer. Please make a complaint of a visible material or production defect or a defect caused by transport immediately, although this is not required for an effective enforcement of claiming a warranty.

Right of Cancellation
You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from
- the date on which you or a third party named by you, who may not be the carrier, have taken possession of the goods,
- in the case of a contract for several items that you have ordered in a single order and that are delivered separately: the date on which you or a third party named by you, who may not be the  carrier, have taken possession of the last delivered goods,
- in the case of a contract for delivery of goods consisting of multiple partial shipments or pieces: the date on which you or a third party named by you, who may not be the carrier, have taken possession of the last partial shipment or the last part of the goods.

In order to observe the cancellation period, it is sufficient that you send notice of your exercising the right of cancellation before expiry of the cancellation period.

Consequences of Cancellation
If you cancel this contract, we are under obligation to reimburse all payments we have received from you, including shipping costs (with the exception of the additional costs arising from your choosing a type of shipment other than the most favourable standard shipment offered by us) without undue delay and at the latest within fourteen days from the date on which we receive notification of your cancellation of this contract. For this reimbursement, we will use the same payment method that you used for the initial transaction, unless we explicitly agree otherwise with you; you will in no event be charged fees for this reimbursement.
We may withhold the reimbursement until we have received the goods back or until you have demonstrated that you have returned the goods, whichever happens first. You must send back or hand over the items without undue delay and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract.
The deadline is met if you send back the goods before the end of the fourteen day period.  You have to bear the direct costs of returning the goods, which are estimated not above 100.00 EUR.
You will only be liable to pay for any diminished value of the items resulting from your handling the items for reasons other than what is necessary for ascertaining the condition, nature and functioning thereof. This will apply in particular when you remove or damage the seal attached.

11.1 Applicable Law

The law of the Federal Republic of Germany shall apply, the United Nations Convention on Contracts for the International Sales of Goods (CISG) expressly excluded.

11.2 Place of Jurisdiction

Düsseldorf (Germany) shall be the sole place of jurisdiction if the customer is a merchant entered in the commercial register as a merchant, a legal entity under public law, or a federal special fund under public law (§ 38 German Civil Litigation Act).

11.3. Applicable Terms and Conditions

The Terms and Conditions of Rhinegold Gallery will supersede any other general terms and conditions binding upon the customer.

11.4 Severability Clause

Eventual ineffectiveness of single provisions does not touch the effectiveness of the remaining provisions. In place of the ineffective provision(s) the relevant legal regulations shall apply.
